This month's issue of The Monitor includes the second half of a two-part series on the current status of legislation affecting the 340B program in state legislatures. This month, we focus on Alaska's efforts to require covered entities that are eligible for the 340B program to purchase their drugs from the program, Hawaii's legislation that will make it easier for 340B entities and their patients to take advantage of telepharmacy, and Connecticut's new proposed timeline for eligible entities to enroll in the 340B program. A brief overview of 340B legislation introduced in Arkansas and Kansas is also provided. A common thread in the legislation is to increase awareness and use of the 340B program. While 340B is a federal program needing no state authority to operate, some states have used legislation to encourage or require qualified entities to use the program, which can reduce costs for state and local governments. Alaska Alaska's legislature is considering two bills that focus on improving pharmaceutical access. One of these bills, House Bill 82, would require providers in the state that are eligible for the 340B program to participate in the program. The bill would also require that the Department of Health and Social Services DHSS ; conduct a study pertaining to prescription drug discounts and report the results to the legislature. Specifically, the report would 1 ; identify health care providers and facilities in the state that meet the definition of a 340B covered entity; 2 ; describe other health care providers and facilities in the state that would benefit from 340B prescription drug discount pricing; and 3 ; list potential benefits to public, private, and third-party payers of prescription drug discount pricing. "While there may be some products that covered entities can get cheaper outside of 340B, it's incredibly unlikely that they'll be able to do so with very many products." says Karmen Hanson, Senior Policy Specialist at the National Conference of State Legislatures. "As a result, this bill would put pressure on [covered entities] to prove that they can save more money working outside of 340B, " she added. "If they can't, they'll be saving themselves and the state money by switching to the 340B program. It's also useful in that it may free pharmacy managers from long-term contracts with higher-priced vendors, " says Hanson. Also included is a provision directing DHSS to provide a list of resources and an application process for entities seeking enrollment in the 340B program. DHSS would also be required to disseminate estimated cost savings for prescription drug discount pricing. Other strategies, such as state bulk purchasing initiatives, state -funded managed care plans, and sole-source contracting, would be explored for the purposes of obtaining the best prices on chronic use drugs. "Prescription drugs are the fastest growing component of health care expenditure, and rising costs have greatly reduced the availability of prescription drugs, " noted a spokesperson for Representative David Guttenberg D ; , the bill's sponsor. "In 2001, nearly 1 in 4 seniors reported skipping doses or not filling prescriptions because of the cost; this bill will reduce the cost of prescription drugs and increase affordable access to prescription drugs for Alaskans, " he added. Prospects for passage are murky at best, according to Marylin Kasmar of the Alaska Primary Care Association. "This piece of legislation definitely isn't going anywhere this year. Our Legislature's session ends the last week of May, but in Alaska we run two year sessions, so it could come up next year" she said. Hawaii Hawaii is looking at ways to ensure that its health care providers are able to improve access to pharmaceutical care for its disparate patient populations. To that end, a bill which would allow pharmacies to dispense 340B medications through telepharmacy is moving swiftly through the legislature. Provided that the 340B eligible patient is not within five miles of a pharmacy staffed with a licensed pharmacist, House Bill 1359 would allow pharmacies to fill 340B prescriptions and arrange delivery over the phone. HB 1359 was introduced by Representative Calvin Say D ; , who did so on behalf of Governor Linda Lingle R ; . The bill passed the House in mid-March, enjoyed a unaniContinued on pg. 5.

Philip Mahoney had just finished his last shift at Braintree Children's, and when he got home, Tahoe gave him a letter from Delorenzo, and played back a call from him on the answering machine. Mahoney felt a certain camaraderie with Delorenzo since they were in the same residency program, having worked many nights together with the adrenalin flowing. Mahoney felt that certain foxhole loyalty of residents who'd worked together for three intensive years. In other words, he had to read Delorenzo's letter and return his phone call. He wished he could have a couple of B & B's to get in the mood for Delorenzo's gloominess, but Delorenzo was surprisingly upbeat. He was writing the Model Emergency Medicine Contract for both hospitals and physicians. Delorenzo was coming through again. It was just like him, physician, humanist, and many times a torchbearer, to put together the formulation of fairness with no bullshit. Joe was calling and writing for feedback. Dear Phil, WHAT GOES HERE??? And a national registry will be set up of all multistate, multiple intrastate, and individual emergency medicine "management" corpora and doral.
Some of these pharmacologic agents are available in combinations. For example, senna, a stimulant, is combined with docusate sodium, a stool softener, and sold as Senokot-S. This particular combination is recommended for narcotic-induced constipation because it helps to overcome the specific problems caused by narcotics. Because opiates are known to decrease longitudinal propulsive contractions that help to move stool downward and because they also allow stool to remain in the colon where it dries out and becomes hard, this combination seems ideal. The mechanism of action of senna is stimulation of longitudinal peristalsis the action that opiates interfere with ; , and docusate sodium helps to soften stools that have become dry and hard.21 The effect of opiates on bowel function is so consistent that some experts.
